According to Hogan's , the regulator's odds of winning are as small as 2.367%. "Same odds as the Jets winning the Super Bowl!" joked the attorney. Hogan explained the reason for being so confident in his conclusion. Hogan adds that after the trial court renews these determinations, an ensuing appeal would be necessary, and only after that, the SEC could win. However, even in this case, Ripple would still be able to appeal to the Supreme Court.
